1. About these Terms

These Terms and Conditions (Terms) govern access to and use of the PressHat mobile application, website (https://www.presshat.com) and related services (together, the Platform). The Platform is operated by PressHat Pty Ltd (PressHat, we, us or our).

By creating an account, accessing account-only features, or publishing content, you agree to these Terms. The Media Terms apply whenever a user uploads or publishes photos, video, audio or related text through PressHat. Our Privacy Policy (https://www.presshat.com/privacy) explains how we handle personal information and is incorporated by reference for transparency, but it is not intended to remove rights provided by privacy law.

If you do not agree, do not create an account or use the relevant feature.

Important: These Terms contain limitations of liability, user warranties, content rules and powers allowing PressHat to restrict or remove content and accounts.

1.1 Acceptance when publishing media

On the Review Upload page, the uploader must actively tick the required checkbox confirming that they:

  • agree to these Terms, including the Media Terms; and
  • acknowledge that they have read the Privacy Policy.

The uploader cannot publish without accepting the required checkbox. A required checkbox must be unticked until the user actively selects it.

1.2 Evidence of acceptance

PressHat may record the version accepted, account ID, upload ID, date and time, device or session details, and the choices and upload settings made on the Review Upload page.

1.3 Additional policies

The following form part of the Platform rules:

  • the Privacy Policy;
  • Community Guidelines and safety notices displayed in the Platform;
  • copyright, privacy and content complaint procedures; and
  • any feature-specific conditions clearly presented before use.

If there is a conflict, a feature-specific agreement controls only for that feature. Within these Terms, the Media Terms control questions concerning uploaded media, downloads, reposting and promotional permission.

1.4 MVP scope

MVP scope: These Terms do not create a paid marketplace, first-look period, exclusive representation, paid commercial licence or PressHat right to sell the Media. They license only Platform operations, downloads, reposting and optional PressHat promotion.

2. Definitions

Commercial use means use primarily for payment, advertising, sponsorship, broadcast licensing, resale, stock-footage distribution, a paid production, commercial promotion or another revenue-generating transaction specifically involving the Media.

Download and Reposting Licence means the limited permission described in section 12.

Media means the uploaded photo, video, audio, thumbnail, caption, headline, description, tags and associated metadata provided to PressHat.

Media Terms means sections 6 to 15 and the Schedule (Review Upload page wording), which replace the separate Media Upload, Download and Reposting Licence Agreement previously published by PressHat.

Promotional Materials means advertising, social-media posts, app-store listings, presentations, demonstrations, campaign materials and other content created to promote PressHat or its services.

Watermarked Copy means a derivative copy produced by PressHat containing the watermark described in section 10.

3. Eligibility and age

You must be at least 16 years old to create or keep an Australian PressHat account.

At signup, you must provide your date of birth and confirm by checkbox that you are aged 16 or over. PressHat validates this information against the minimum age requirement and may take further reasonable steps to assess or verify age where necessary. PressHat may restrict or close an account where the age requirement is not satisfied, and other users may report a suspected underage account through the in-app reporting tools.

You must be legally capable of entering a binding agreement. If you use PressHat for a company or organisation, you confirm that you are authorised to bind that entity.

4. Accounts and security

You must:

  • provide accurate information and keep it reasonably current;
  • use a handle that does not unlawfully impersonate another person or organisation;
  • keep passwords and authentication methods secure;
  • promptly tell PressHat about suspected unauthorised access;
  • not sell, transfer, rent or share an account;
  • not create replacement accounts to evade enforcement; and
  • not use bots, scraping, automated account creation or unauthorised interfaces.

PressHat may require additional verification where reasonably necessary for safety, fraud prevention, age assurance, ownership verification or compliance with law. Public users may use a pseudonym, but PressHat may retain verified information privately where justified.

5. Purpose of the Platform

PressHat is a citizen-journalism and community-information platform that allows users to publish, discover, discuss, map and share newsworthy or locally relevant material.

PressHat is not:

  • an emergency service;
  • a substitute for police, fire, ambulance or other emergency authorities;
  • a guarantee that content is true, complete, authentic or lawful;
  • a professional legal, medical, safety or financial advisory service; or
  • a promise that any content will receive media attention or generate income.

If there is an emergency or immediate danger, contact the appropriate emergency service directly.

6. Ownership of user content

Users retain the copyright and other ownership rights they lawfully hold in content submitted to PressHat, including Media. Uploading does not transfer copyright or ownership to PressHat.

The uploader can publish or license the original Media elsewhere, subject to any separate agreement they independently enter. The MVP does not impose exclusivity or a first-look period.

The rights needed by PressHat to operate the Platform are set out in sections 8 to 14. PressHat does not receive an automatic right to sell or commercially license an upload, and the MVP does not include a paid media marketplace, first-look period, exclusive representation or licensing commission.

Copyright ownership may belong to another person or organisation where the footage was recorded during employment, commissioned, jointly created or previously assigned. The uploader is responsible for confirming their authority.

You are responsible for keeping your own original and backup copy. PressHat is not an archival service and does not guarantee permanent storage.

7. User promises and authority

When you publish content, you represent and warrant that, to the best of your knowledge:

  • you own it or have sufficient permission or authority from the owner to publish it and grant the rights in these Terms;
  • you have not granted conflicting exclusive rights;
  • you have disclosed material co-ownership, employment, commission, agency or pre-existing exclusive arrangements that could affect the rights;
  • publishing it through PressHat is not unlawful;
  • it was not obtained through unlawful conduct;
  • its headline, description, date, location and context are not knowingly false or materially misleading;
  • material edits, staging, synthetic elements or AI generation are disclosed;
  • any selected social-media handle belongs to you or you are authorised to use it;
  • you will provide reasonable evidence of ownership or authenticity if requested, and will reasonably assist PressHat to investigate an ownership, authenticity, privacy or safety complaint; and
  • you will not use PressHat to harass, endanger, deceive or unlawfully identify another person.

You are solely responsible for determining and warranting your ownership of, or authority over, content you publish. PressHat does not pre-screen uploads for ownership and does not conduct clearance searches before accepting uploads, although PressHat may use automated tools to identify duplicates, manipulation and potential infringement, and operates a takedown and appeals process for reported concerns. Using those tools does not make PressHat responsible for verifying ownership before publication. If you publish content that you do not own or do not have permission to use, you are solely liable for the resulting claims, losses and enforcement action.

PressHat may request the original file, metadata, written permission, proof of identity or other evidence. PressHat may disable downloads, restrict visibility or remove content while investigating a credible ownership, privacy, safety or authenticity concern.

8. Operational licence granted to PressHat

The uploader grants PressHat a non-exclusive, worldwide, royalty-free licence to use the Media only as reasonably necessary to operate, secure, moderate and improve the Platform, including to:

  • upload, receive, host and store the Media;
  • copy, reproduce and back it up for technical and operational purposes;
  • transcode, compress, resize, reformat and optimise it;
  • create thumbnails, previews, still frames, excerpts and lower-resolution derivatives;
  • generate captions, transcripts and translations;
  • apply visible and invisible watermarks, file hashes and provenance identifiers;
  • display it in PressHat feeds, profiles, maps, alerts, search, comments and community features;
  • communicate it to PressHat users;
  • make Watermarked Copies available when downloads are enabled;
  • allow the social reposting permitted by these Terms;
  • provide access to moderators, Jury Duty systems, verification personnel and service providers acting for PressHat;
  • identify duplicates, manipulation, abuse, infringement and security threats;
  • preserve evidence for moderation, fraud, copyright, safety and legal disputes; and
  • maintain backup and disaster-recovery copies.

PressHat may allow infrastructure, hosting, security, moderation and technical providers to process the Media on PressHat's behalf, subject to appropriate restrictions.

This operational licence does not authorise PressHat to sell the Media or grant a paid commercial media licence during the MVP.

9. Editing and technical processing

PressHat may make technical and presentation changes reasonably required for the Platform, including:

  • cropping or resizing to fit interfaces;
  • changing format, codec, bitrate or resolution;
  • generating previews and thumbnails;
  • adding captions, translations and content warnings;
  • removing or obscuring sensitive metadata;
  • blurring faces, addresses, number plates or other identifiers for safety or privacy;
  • removing or muting audio where necessary; and
  • adding PressHat branding, attribution and location information.

PressHat should not materially change the factual meaning of the Media. The uploader acknowledges that automatic captions, translations and metadata assessments may contain errors.

10. Watermark

Every downloadable copy should include a visible watermark containing:

  • PressHat branding;
  • the uploader's chosen social-media handle or handles; and
  • broad location information limited to suburb and city.

A typical watermark may read: @UploaderHandle | Fitzroy, Melbourne | PressHat

The watermark must not ordinarily display:

  • the uploader's legal name unless chosen publicly;
  • a residential or street address;
  • exact GPS coordinates;
  • device serial numbers;
  • private account details; or
  • unnecessary metadata.

PressHat may omit, shorten or generalise a handle or location where reasonably necessary for privacy, safety, moderation, legal compliance or protection of a vulnerable person or location.

PressHat may also embed an invisible forensic watermark, file fingerprint or unique content identifier.

11. Downloads are enabled by default

The Allow watermarked downloads toggle is on by default for each upload.

Before publishing, the uploader can switch the toggle off on the Review Upload page. The interface clearly explains that:

  • a copy may leave PressHat;
  • downloaded copies may be publicly reposted on social media;
  • PressHat may not be able to retrieve a downloaded or reposted copy;
  • a watermark reduces but cannot prevent misuse; and
  • enabling downloads does not transfer ownership or grant a commercial media licence.

The uploader may disable future downloads at any time after publication. PressHat may also disable downloads for a legal, safety, privacy, ownership, moderation or Platform-integrity reason.

When downloads are enabled, registered users may download and publicly repost a Watermarked Copy on external social-media platforms under the Download and Reposting Licence. This permission does not transfer ownership or grant commercial broadcast, paid advertising, stock-library, resale, sublicensing or AI-training rights.

12. Download and Reposting Licence

When the uploader leaves downloads enabled, the uploader grants each registered downloader a limited, non-exclusive, royalty-free, non-transferable and non-sublicensable licence to:

  • download the Watermarked Copy; and
  • publicly repost that Watermarked Copy on external social-media platforms.

A downloader may add brief commentary, captions or context and may resize or crop the Watermarked Copy only if the PressHat watermark, uploader attribution and broad location remain clearly visible and the edit does not materially mislead viewers.

Where reasonably practical, the downloader should identify or link to the original PressHat post.

12.1 Conditions of reposting

The downloader must:

  • keep the watermark visible and unobstructed;
  • preserve the uploader's selected attribution;
  • not claim ownership or authorship;
  • not falsely identify the uploader or creator;
  • not materially alter the meaning or sequence of events;
  • not use false, defamatory, deceptive or dangerously misleading captions;
  • not present a material edit as an unaltered original;
  • comply with law and the external platform's rules; and
  • remove, restrict or correct the repost where PressHat reasonably requests this because of a legal, safety, privacy, ownership or moderation concern.

12.2 Uses not granted

The Download and Reposting Licence does not permit a downloader to:

  • sell the Media or charge another person for access to it;
  • grant a licence or sublicense to another person;
  • submit it to a stock-footage library, media-licensing platform, content-licensing service or similar commercial media-distribution service;
  • use it in paid advertising, sponsorship or a brand campaign;
  • license or supply it for television broadcast, a commercial news package, film, documentary or paid production;
  • place it behind a paywall or sell access to the original asset;
  • remove, hide, blur or crop out the watermark;
  • use it to train a general-purpose AI model, facial-recognition system or biometric database;
  • imply endorsement by the uploader or PressHat; or
  • use it in an unlawful, defamatory, harassing or materially misleading context.

A separate licence from the copyright owner would be required for those uses. The MVP does not provide a PressHat marketplace for obtaining that licence.

12.3 Ordinary monetised social accounts

General account monetisation does not by itself breach these Terms. A downloader's social-media account may receive incidental platform advertising revenue, provided the specific repost is not sponsored, sold, paywalled, licensed or primarily used as a commercial advertisement.

13. Effect of disabling downloads or deleting the Media

Disabling downloads or deleting the upload:

  • prevents future downloads through PressHat;
  • does not automatically erase copies already downloaded;
  • does not automatically revoke a compliant repost already made;
  • does not require PressHat to retrieve content from third-party platforms, caches, archives, screenshots or backups outside PressHat's control; and
  • does not prevent enforcement against a downloader who breached these Terms.

PressHat may request removal or correction of an external repost where it creates a serious legal, safety, privacy, ownership or moderation risk.

14. Optional PressHat marketing permission

The full promotional permission is included in these Terms, but it is not activated merely because the uploader accepts the required publishing checkbox.

On the Review Upload page, PressHat provides a separate optional checkbox, unticked by default:

Allow PressHat to use this content for marketing

I give PressHat permission to reproduce, edit and display this content in PressHat advertising, social media, app-store listings, presentations and other promotional materials. If I later withdraw this permission or delete the content, PressHat may continue using promotional materials that were already created, published, distributed or contractually committed, but will not ordinarily create new campaigns using the content.

If selected, the uploader grants PressHat a non-exclusive, worldwide, royalty-free licence to:

  • reproduce, edit, crop, resize, caption and format the specific Media;
  • combine it with PressHat branding, text, music or other campaign material where lawful;
  • publish and display it in Promotional Materials;
  • provide completed or committed Promotional Materials to advertising, app-store, social-media, event, presentation and production partners; and
  • retain records proving the permission granted.

Unless separately agreed, PressHat is not required to pay the uploader for promotional use.

14.1 Withdrawal or deletion

The uploader may withdraw promotional permission for future materially new campaigns by contacting PressHat or using an available setting.

After withdrawal or deletion, PressHat may continue using Promotional Materials already:

  • created or substantially produced;
  • published or distributed;
  • posted on PressHat social-media accounts;
  • incorporated into an app-store listing, presentation or completed campaign;
  • supplied to an advertising, production or media partner; or
  • subject to a binding production, advertising or distribution commitment.

PressHat will not ordinarily create a materially new promotional campaign using the Media after withdrawal. PressHat may remove or discontinue existing Promotional Materials at its discretion and may be required to do so because of law, safety, privacy, ownership or platform rules.

PressHat cannot guarantee removal from third-party archives, caches, reposts, screenshots, physical materials or services outside its control.

14.2 Attribution in promotions

PressHat may use the uploader's selected handle where reasonably practical, or may omit attribution where space, safety, privacy or campaign context reasonably requires. PressHat must not falsely attribute the Media to another creator.

15. No marketplace, exclusivity or first-look rights in the MVP

For the MVP:

  • PressHat cannot sell or commercially license the Media;
  • PressHat does not act as the uploader's exclusive or non-exclusive licensing agent;
  • no licensing commission is payable;
  • no first-look period applies;
  • the uploader is not prevented from dealing with a newsroom or any external licensing platform; and
  • PressHat has no right to negotiate or accept a commercial offer for the uploader.

Any future marketplace, standard licence, exclusive licence, rights-management arrangement, commission or first-look period must be introduced through a separate agreement and clear opt-in acceptance. It will not apply retroactively merely because the uploader accepted these Terms.

16. Prohibited content and conduct

You must not upload, request, publish, download, repost or otherwise use content that:

  • sexually exploits or abuses a child;
  • contains non-consensual intimate imagery;
  • credibly threatens, promotes or facilitates violence or serious wrongdoing;
  • unlawfully promotes terrorism or violent extremism;
  • exposes private addresses, exact locations or other information in a manner likely to create danger;
  • unlawfully identifies protected children, witnesses, jurors, victims or complainants;
  • breaches a suppression order, confidentiality duty or lawful restriction;
  • infringes copyright, privacy, trade mark or other rights;
  • is deliberately fabricated or materially manipulated but presented as authentic eyewitness material;
  • contains fraudulent dates, locations, descriptions or metadata;
  • is defamatory, harassing, hateful or targeted abuse;
  • encourages interference with emergency responders or active operations;
  • contains malware, scams, spam or deceptive links;
  • is obtained or distributed unlawfully; or
  • otherwise exposes PressHat, users or the public to an unacceptable legal or safety risk.

Newsworthy content may still be distressing or graphic. PressHat may label, blur, age-restrict, limit, geo-restrict, remove audio from, disable downloads for, or remove such content.

17. Reporting, blocking and moderation

PressHat provides tools to report content, replies, accounts and other conduct directly in the app, and to block users. In-app reporting is the primary channel for content concerns. For urgent safety or legal concerns, users may also contact report@presshat.com. PressHat aims to respond to reports in a timely manner, having regard to the urgency and seriousness of the issue. Users must not submit knowingly false, coordinated or abusive reports.

PressHat may, but is not required to, review any content. To protect users and the Platform, PressHat may:

  • use automated tools and human review;
  • request supporting information or original files;
  • label content as disputed, unverified, edited or sensitive, or add warnings or context;
  • reduce distribution or remove content from maps, alerts or recommendations;
  • disable downloads or comments;
  • blur identifying details or generalise or remove locations;
  • temporarily quarantine or permanently remove content;
  • warn, restrict, suspend or terminate an account;
  • preserve evidence, including a restricted evidence copy; and
  • notify affected parties, authorities or emergency services where permitted or required by law.

PressHat may act before completing an investigation where it reasonably considers this necessary for safety, fraud prevention, legal compliance or Platform integrity. These actions do not transfer ownership to PressHat and do not create an obligation to monitor every upload or external repost.

17.1 Appeals

Unless an urgent safety, legal or confidentiality issue prevents it, a user may submit one appeal within 14 days of notice. PressHat may decline repetitive, abusive or bad-faith appeals. A decision may be reconsidered where significant new evidence becomes available.

18. Misuse of Media, evidence and enforcement

Users may report suspected misuse directly in the app using the report tools, or by contacting report@presshat.com.

PressHat may:

  • preserve upload and download records;
  • identify the account associated with a Watermarked Copy;
  • issue a platform report or takedown request;
  • suspend or terminate a downloader;
  • provide relevant information to the uploader, a court or authority where permitted by law; and
  • take reasonable enforcement action.

PressHat does not guarantee that it will detect, prevent or successfully remove every unauthorised copy. Unless separately agreed, PressHat is not obliged to fund litigation or act as the uploader's legal representative.

19. Jury Duty and community moderation

Where Jury Duty is available, it is a community input into moderation and not a court, legal determination, professional service or substitute for PressHat's own review.

Jurors must:

  • maintain confidentiality;
  • assess only the material provided;
  • disclose conflicts and decline where appropriate;
  • not contact or identify the parties;
  • not coordinate votes or manipulate the process; and
  • comply with all case-specific instructions.

PressHat retains final authority and may override, set aside or decline to implement a jury outcome for legal, safety, fairness, technical or operational reasons. Jury participation does not create employment, agency or professional obligations between PressHat and the juror.

20. Credibility, reputation and automated systems

PressHat may generate credibility indicators, Community XP, Moderation Trust, reputation measures or other signals using information such as metadata, device or file consistency, uploader history, community verification and moderation outcomes.

These indicators:

  • are estimates based on available information;
  • are not guarantees of truth, legality or authenticity;
  • may be affected by missing or incorrect information;
  • may be revised or removed; and
  • must not be treated as professional certification.

PressHat may use automated systems to prioritise review, identify spam, detect manipulation, recommend content and calculate preliminary signals. Users may request review of a significant decision based on inaccurate personal information, subject to reasonable verification and operational limits.

21. Public information, location and metadata

Content and profile information selected for publication may be visible to other users and may be copied, shared or indexed outside PressHat.

Downloaded footage may display the watermark described in section 10: PressHat branding, the uploader's selected social-media handle or handles, and broad location information consisting of suburb and city.

Location is central to how the Platform works. PressHat extracts and retains the exact GPS coordinates from the embedded metadata of content you upload, and uses them to place content on the interactive map and to help verify reported events, including, as the Platform develops, by cross-referencing reports from other users in the same area. By default, content appears on the map at the exact location taken from its metadata. You can choose to display a broader location instead, such as the street or suburb, for example where content was captured in a sensitive area. You can upload content without location information, but it may receive a lower credibility score. PressHat does not currently collect location continuously in the background; any future feature that does so will be optional and will be explained in the app and the Privacy Policy before it is used. Exact GPS coordinates and unnecessary embedded metadata do not appear in the watermark on downloaded footage. PressHat should not publicly expose a legal name, residential address, device identifier or unnecessary embedded metadata unless the user clearly chooses this or law requires it. PressHat may omit or generalise a handle or location where reasonably necessary for privacy, safety, moderation or legal reasons.

The uploader's permission does not necessarily resolve the rights of every identifiable person appearing in the Media. PressHat may restrict or remove Media where distribution creates a serious privacy, safety or legal risk. The Privacy Policy explains how PressHat handles Media, metadata and complaints from non-users.

22. Moral rights and attribution

Nothing in these Terms transfers the creator's moral rights. To the extent permitted by law, the uploader consents to the technical processing, formatting, captioning, watermarking, safety editing and optional promotional editing expressly described in these Terms.

PressHat and downloaders must not knowingly falsely attribute the Media or materially distort it in a way prohibited by applicable law. The uploader acknowledges that ordinary technical compression, cropping, excerpts, captions and translations may change presentation without changing ownership.

23. PressHat intellectual property

PressHat and its licensors own the Platform, software, designs, branding, databases, interfaces, logos and other material supplied by PressHat, excluding user-owned content.

PressHat grants you a limited, personal, revocable, non-transferable right to use the Platform for its intended purpose. You must not:

  • copy, reverse engineer or commercially exploit Platform software except where law permits;
  • remove PressHat branding or security measures;
  • scrape, index or extract Platform data without written permission;
  • use PressHat branding in a misleading manner; or
  • create a competing database or service from PressHat content or metadata.

24. Feedback

If you voluntarily provide product suggestions or feedback, you grant PressHat a worldwide, perpetual, royalty-free right to use and develop that feedback without payment or attribution, provided this does not transfer ownership of uploaded media.

25. Third-party services and notifications

The Platform depends on third-party services, including Amazon Web Services, Google Firebase (Cloud Messaging, Analytics, Crashlytics and Performance Monitoring) and Apple Push Notification service. The Privacy Policy explains what information these services receive. Third-party services may be unavailable, changed or governed by their own terms.

Push notifications are provided for convenience. PressHat does not guarantee that an alert will be delivered, delivered on time or seen. Users should not rely on PressHat notifications for emergencies or immediate safety decisions.

Links to third-party websites do not constitute endorsement. PressHat is not responsible for third-party content, security or privacy practices.

26. Suspension, termination and account deletion

You may stop using PressHat and request account deletion through the in-app pathway or the public deletion webpage at https://www.presshat.com/delete-account (by signing in to your account).

PressHat may warn, restrict, suspend or terminate access where it reasonably believes that you:

  • breached these Terms or another Platform agreement;
  • created a safety or legal risk;
  • engaged in fraud, harassment, infringement or serious deception;
  • manipulated moderation, Jury Duty or credibility systems;
  • evaded a previous restriction; or
  • exposed the Platform or other users to material harm.

PressHat may retain limited records after deletion where reasonably necessary for legal obligations, security, fraud prevention, moderation evidence, dispute resolution or enforcement. Section 27 and the Privacy Policy explain the treatment of deleted data and media.

27. Deletion of Media and survival

The operational licence in section 8 ends when the Media is deleted, except to the limited extent reasonably necessary to:

  • complete deletion from active systems and backups;
  • preserve moderation, safety, fraud, copyright or legal evidence;
  • investigate or enforce a breach;
  • retain agreement, download and consent records; and
  • continue existing Promotional Materials as described in section 14 where optional permission was granted.

The Download and Reposting Licence for copies lawfully obtained before downloads were disabled or the Media was deleted continues for compliant existing copies and reposts, subject to the conditions and PressHat's right to request action for a serious legal, safety or privacy issue.

28. Changes to or withdrawal of the Platform

PressHat may add, change, suspend or discontinue features, including feeds, maps, alerts, downloads, moderation systems and credibility indicators. PressHat does not guarantee that any feature will always be available or remain unchanged.

Where reasonably practicable, PressHat will provide notice of a material change that significantly affects user rights. Immediate changes may be made for security, safety, legal compliance or urgent operational reasons.

29. Disclaimers

To the maximum extent permitted by law:

  • the Platform is provided on an "as available" and "as is" basis;
  • PressHat does not warrant uninterrupted, secure or error-free operation;
  • PressHat does not guarantee the accuracy, authenticity, legality, availability or completeness of user content, or that an uploader owns the Media or that every description or location is accurate;
  • PressHat does not guarantee that a watermark will prevent copying, editing, removal or misuse;
  • PressHat does not guarantee that a downloader will comply with these Terms, that an external platform will remove a repost, or that deleted content will disappear from third-party systems;
  • PressHat does not guarantee that content will attract publicity or licensing interest, or be licensed, purchased or published, or generate income;
  • users are responsible for retaining original files and independent backups; and
  • users must exercise their own judgment before relying on content or acting in a potentially dangerous situation.

Nothing in these Terms excludes guarantees, rights or remedies that cannot lawfully be excluded, including consumer guarantees under the Australian Consumer Law.

30. Liability exclusions and cap

To the maximum extent permitted by law, PressHat excludes liability arising from:

  • user content or user conduct;
  • unauthorised copying, reposting, editing or misuse by another person;
  • lost, delayed, failed or corrupted uploads;
  • anticipated or actual licensing revenue, licensing opportunities, or income from content, including where content is copied, reposted or commercially exploited by a third party, whether or not in breach of these Terms;
  • service outages, maintenance or third-party infrastructure failures;
  • missed alerts or notifications;
  • reliance on a credibility score, verification indicator, location or description;
  • deletion or restriction performed in good faith under these Terms;
  • third-party websites or services; and
  • indirect, consequential, special or speculative losses, including loss of opportunity, loss of reputation or loss of profits.

Where liability cannot lawfully be excluded, PressHat's total aggregate liability arising out of or relating to the Platform is limited to AUD $100.

This cap does not limit:

  • liability that cannot legally be limited or excluded, including under the Australian Consumer Law; or
  • liability arising from PressHat's fraud or wilful misconduct.

31. Indemnity

To the maximum extent permitted by law, you indemnify PressHat and its officers, employees and contractors against third-party claims and reasonable losses directly resulting from:

  • your breach of the ownership and authority warranties in section 7;
  • your upload or publication of content that infringes another person's copyright, privacy, trade mark or other rights;
  • deliberately false, fraudulent or unlawful content;
  • your unauthorised commercial licensing or sale of another person's content;
  • your use of another person's account or identity without permission; or
  • deliberate interference with Platform security or moderation systems.

The indemnity does not apply to the extent a loss was caused by PressHat's own breach, negligence, unlawful conduct or failure to take reasonable steps to reduce the loss.

32. Complaints, disputes and governing law

Users should first contact PressHat using the relevant support, privacy or content-complaint channel. The parties will attempt to resolve a dispute in good faith.

These Terms are governed by the laws of Victoria, Australia. Subject to rights that cannot be excluded, the courts of Victoria and applicable Commonwealth courts have jurisdiction.

Nothing in this section prevents a user from contacting a regulator, law-enforcement authority, consumer body, privacy authority or court where legally entitled.

33. Changes to these Terms

PressHat may update these Terms for legal, safety, security, technical, operational or commercial reasons. PressHat will identify the current version and effective date, and the version accepted for each upload.

For material changes, PressHat will provide reasonable notice and may require renewed acceptance. A change that materially expands PressHat's rights over an existing upload, including a paid marketplace, commercial media licensing, exclusive representation, exclusivity, first-look rights or general-purpose AI training, requires separate express consent and will not be imposed solely through continued use.

34. General terms

If part of these Terms is invalid or unenforceable, the remainder continues to operate to the extent possible.

A failure to enforce a term immediately is not a waiver. You may not transfer your account or rights under these Terms without PressHat's written approval. PressHat may transfer these Terms as part of a genuine corporate restructure, merger, acquisition or sale of the relevant business, subject to applicable law and privacy obligations.

These Terms (including the Media Terms) and incorporated policies constitute the agreement concerning use of the Platform.

I confirm that I own this content or have authority to upload it. I grant PressHat the rights required to host, process, watermark, display, moderate and provide permitted downloads and reposting through the PressHat service.

Default-on download toggle

Allow watermarked downloads - ON by default

Other users may download and repost a watermarked copy on social-media platforms. You continue to own the footage. This does not grant commercial licensing rights. Copies already downloaded or reposted may not be retrievable if you later disable downloads or delete the upload. You can turn downloads off now, or at any time after publishing.

Separate optional checkbox

Allow PressHat to use this content for marketing

I give PressHat permission to reproduce, edit and display this content in PressHat advertising, social media, app-store listings, presentations and other promotional materials. If I later withdraw this permission or delete the content, PressHat may continue using promotional materials that were already created, published, distributed or contractually committed, but will not ordinarily create new campaigns using the content.
